The Partner Visa 801 Australia is a permanent partner visa granted to people who are already in Australia and are in a committed relationship with an Australian citizen, permanent resident, or an eligible New Zealand citizen.
This visa is the second part of a two-stage process:

Once the 801 visa is granted, you can stay in Australia forever, work, study, and even apply for citizenship later.
To apply for the partner visa australia 801, you must already hold the Partner Visa 820. If you’re applying from inside Australia, this process is common.

You usually apply for both the Partner Visa 820 and Partner Visa 801 australia at the same time. But the 801 visa is only processed after 2 years from the date you submitted your combined application.
Near the end of those two years, the Department of Home Affairs will ask you for updated relationship evidence to show your relationship is still strong and genuine.
If approved, you’ll move from a temporary partner visa to a 801 permanent partner visa — no extra application fees needed.
Getting the Partner Visa 801 opens the door to many opportunities in Australia. Here’s what it gives you:
The Australian government wants to make sure that your relationship is real not just for the sake of the visa. So, you’ll need to provide proof.
Life happens and sometimes, relationships don’t last. If your relationship ends after you get your temporary visa but before the 801 visa is granted, you must inform the Department of Home Affairs.
You might still be eligible for the permanent partner visa in some situations:
You do not pay any additional government fee specifically for the 801 visa. When you apply for the combined 820/801 (temporary + permanent partner visas), you pay one upfront fee that covers both stages. Here’s how it works:
One combined application fee: AUD 9,095* for the main applicant.
Extra fees for dependents: AUD 4,550* for each applicant aged 18 + or AUD 2,280* for those under 18.
You don’t pay again when the 801 visa is processed; no second payment at the 2-year stage

Once you’ve held the temporary Partner Visa 820 for two years, the Department will invite you to lodge Stage 2 – permanent visa documents via ImmiAccount. Log in, select “New application” → Family → Stage 2 – Permanent Partner Visa (801), and attach updated relationship evidence and any new health or character documents
They’ll look for updated proof that your relationship remains genuine and continuing. This can include:
New joint financial documents (bank statements, bills)
Shared living arrangements or lease renewals
Recent photos, travel patterns, messages
Statutory declarations from friends/family
Yes—if you have a Bridging Visa B (BVB). After lodging your 820, you might need to request a BVB to re-enter Australia during your 801 processing period. Make sure to apply in time via ImmiAccount to maintain travel rights
Absolutely. Dependent children listed in your initial 820 application can continue on to the 801. You’ll need to provide birth certificates, updated health and character documents, and any proof of dependency if they’re over 18 (but studying full-time or permanently disabled)
After the 2-year wait on the 820 visa, the 801 processing typically takes 20–26 months, depending on completeness of evidence. Some cases may be approved earlier—especially with long‑term relationships or children involved
If your relationship ends before the permanent visa is granted, you must notify Home Affairs immediately via ImmiAccount (using Form 1022 for changes in circumstances). There are limited exceptions—like cases involving family violence, shared children, or your partner’s death—where you might still be eligible.
