Permanent residency in Australia may feel like you’ve crossed the finishing line but for UK citizens, it usually marks the starting point of another timer, which begins to run as and when you become an Australian citizen. Australian citizenship is governed by an altogether different time frame, which has different eligibility dates and one of the quickest and easiest routes to getting your application knocked back for a few months is applying late.

How Soon Can You Apply? The 4-Year Residence Rule

Everyone would think after getting PR in Australia, Australia citizens is just around the corner. The truth is the Department of Home affairs follows a general residence requirement rules which state you need to have lived in Australia lawfully for the last four years before applying, including the last twelve months as a permanent resident. This applies regardless to your stream of PR applications, it could be a skilled visa, a partner visa or an Australia PR via an investment route like business and investor stream.

Normally, the time spent lawfully living in Australia prior to your PR approval can be accumulated to contribute to the four year requirement and the last 12 months however can only accumulate as a permanent visa holder.

Although this does include the Special category visa(subclass 444) for a certain category New Zealand citizens. Another requirement: ” absence from Australia may not be more than 12 months in total over the full four year period and you may not have been absent from Australia for 90 days or more in the 12 months immediately prior to the date you lodge you application for Australian citizenship”, this means the timeframe depends on when your lawful stay began.

What Counts Toward Your Residence Period

Australia celebrates different days throughout the year in a special way, so you really want to know which time actually counts when lodging the Citizenship application:

  • Time on a student visa prior to grant of PR
  • Time on a bridging visa in support of an application for a valid substantive visa
  • Time held on a partner visa (subclass 820) prior to being granted PR partner visa (801)
  • Time on skilled visas (e.g. 189, 190 or 491) which allowed PR to be granted
  • Time held as a permanent resident
  • Time on a Special Category visa (444) allowed by Eligible New Zealand citizens

Meeting Australia's Other Citizenship Requirements

The residence criteria are not the only factor however. In terms of fulfilling the entire qualification criteria for Australian citizenship, a couple more requirements need to be met prior to your citizenship application being accepted by the Department.

You will not have to renounce your British nationality or hand in your UK passport if you apply to become a citizen of Australia; dual nationality between the UK and Australia exists in both directions, and there is absolutely no conflict at all.

One thing that you must note is that you actually do not become an Australian citizen when you pass your test or when your application has been successful; you become one when you make the oath or declaration of allegiance at the citizenship ceremony. Until you attend this ceremony, you will continue to be both a UK citizen only, and an Australian permanent resident-when the ceremony is completed, you will then hold dual citizenship.
